Viva Local is a free program that connects local restaurants with nearby employees through daily email digests featuring lunch specials and happy hour deals. The service includes:
- A daily email digest of restaurant specials for subscribers
- A self-service portal for restaurants to post and manage specials
- A web page displaying today's specials
- Company-branded signup pages for business partners
3. User Accounts
The service supports three types of users:
- Subscribers: Individuals who sign up to receive daily specials emails
- Restaurants: Food service businesses that post specials through the restaurant portal
- Administrators: Chamber staff who manage the program
Restaurant accounts require a login. You are responsible for maintaining the security of your account credentials.
4. Subscriber Terms
As a subscriber, you understand that:
- The service is free and you will not be charged
- You will receive daily email digests
- You may unsubscribe at any time via the link in any email or at local.goviva.ai/unsubscribe
- Your email address will only be used for Viva Local communications
5. Restaurant Terms
As a participating restaurant, you agree to:
- Post accurate and current specials information
- Honor the deals you post for the time period specified
- Not post misleading, offensive, or inappropriate content
- Keep your restaurant profile and contact information up to date
We reserve the right to remove any specials or restaurant listings that violate these guidelines.
6. Intellectual Property
The Viva Local name, logo, website design, and software are the property of Viva AI Inc. Restaurants retain ownership of their content (menu items, descriptions, images). By posting content, restaurants grant Viva a non-exclusive license to display it within the Viva Local service and email digests.
7. Disclaimers
Viva Local is provided "as is" without warranties of any kind. We do not guarantee:
- The availability, accuracy, or quality of any restaurant special
- That deals will be honored by participating restaurants
- Uninterrupted or error-free service
- That emails will be delivered to your inbox (email delivery depends on your provider)
Restaurant specials are posted by the restaurants themselves. Viva is not responsible for the content, pricing, or availability of any deal.
8. Limitation of Liability
To the fullest extent permitted by law, Viva AI Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service. Our total liability for any claim arising from the service shall not exceed $100.
9. Termination
We may suspend or terminate any account or user's access to the service at any time, with or without cause. Subscribers may terminate by unsubscribing. Restaurants may terminate by contacting us to deactivate their account.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Santa Clara County, California.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email to active subscribers and restaurant accounts. Continued use of the service after changes constitutes acceptance of the updated Terms.
